Title IX Coordinator

CONTEXT OF THE JOB:

The Title IX Coordinator has responsibility for overseeing the university's compliance with Title IX of the Education Amendments of 1972 and other laws and rules relating to discrimination based on sex or gender, including sexual harassment and related misconduct on campus. The individual is responsible for coordinating the development of a comprehensive Title IX training, education, and awareness program; coordinating and directing the disciplinary process in cases that implicate the university's Title IX -related policies; monitoring developments in the law and best practice and recommending changes to the university's policies and practices; and providing leadership in all areas implicated by Title IX and related laws.

Under limited direction, the Title IX Coordinator is responsible for conducting investigations, handling informal resolutions of complaints of discrimination and harassment through both informal conflict resolution and formal investigation, and assisting in resolving complaints of sexual misconduct to include, sexual harassment, domestic/dating violence, stalking, retaliation. and protected class discrimination and harassment involving employees, undergraduate and graduate students at the University, and when necessary, complaints of discrimination, based on a protected class, such as race, religion, national origin, sexual orientation, etc. Title IX prohibited conduct includes discrimination on the basis of gender (sex), which includes sexual harassment, sexual assault, dating/domestic violence and stalking.

The Title IX Coordinator partners with key designees throughout the investigative process, conducting legally sufficient investigations, meeting established timelines and treating all constituents engaged in the complaint process with sensitivity and neutrality.

The Title IX Coordinator will assist, as needed, with campus training, reporting, and campus programming and outreach. The Title IX Coordinator acts as a neutral party in the investigation and provides a detailed unbiased report regarding the findings of the investigation.

MAJOR RESPONSIBILITIES:

Title IX Program Administration:
  • Monitor and provide oversight of Title IX Compliance and the prevention of harassment and discrimination at the University, including coordination of training, education, communications, and administration of grievance procedures for faculty, staff, students and other members of the University community. Oversees and provides guidance and enforcement of the Protection of Minors policy.
  • Provide ongoing consultation and updates regarding Title IX requirements, grievance issues, compliance programs, case management approach, status, and progress to the President, Executive Vice President, and Provost.
  • Prepare and disseminate educational materials, including brochures, posters, and web-based materials that inform members of the campus community of Title IX rights and responsibilities.
  • Provide education and training to students, faculty and staff on issues of prohibited harassment or discrimination, including sexual harassment and sexual violence.
  • Select and provide guidance to deputy Title IX coordinators and case advisors who serve as additional information resources on issues of sexual harassment; train student peer educators to facilitate discussions with other students on sexual harassment.
  • Remain knowledgeable of current state and federal law, regulations, guidance and trends in the field of education related to harassment and other discriminatory practices that violate Title IX.
  • Organize and maintain Title IX grievance files and disposition reports.
  • Prepare annual statistical reports for the campus community on the incidence of sexual harassment.

Investigations:
  • Investigates cases alleging employee and/or student-related sexual misconduct to include sexual assault, sexual harassment, dating/domestic violence, and stalking.
  • Ensures all parties involved in investigations understand the investigatory process, their rights and responsibilities, and how to access other resources as necessary. Provide guidance and assistance to alleged victims of sexual misconduct and sex/gender discrimination.
  • Interviews the complainant, respondent, and relevant witnesses. Gathers relevant evidence. Acts as a neutral party through all aspects of investigation and ensure a prompt, fair, and neutral process for all parties.
  • Maintains a high level of confidentiality during all proceedings with the utmost discretion and sensitivity, including information from individuals who may be experiencing distress.
  • Ensures a well-documented Title IX investigative process. Maintains accurate and thorough records and notes of investigatory process. Creates comprehensive written investigative reports that clearly identify the issues investigated, summarize the evidence, makes findings under University policy, and recommends appropriate remedial steps.
  • Collaborates with on and off campus resources including law enforcement and victim services in resolving complaints and works with others to ensure that the University's processes, responses, and policies are consistent with federal and state laws and regulations related to compliance with non-discrimination laws.
  • Identifies and integrates best practices in the Title IX investigation arena into knowledge base and practice. Stays abreast of current movements in the field of student conduct investigations by participating in conferences, workshops, etc. Participates in the student conduct, employee grievance and Faculty Welfare & Privileges hearing processes as needed.

Other:
  • Participates in local, regional and/or national professional associations and organizations.
  • Manages policies and procedures, which govern programs involving minors.
  • Maintains a database of programs involving minors and ensures those programs complies with University policies.
  • Maintains a database and files for restraining/no contact orders or protections from abuse orders submitted by students, faculty and staff.
  • Works closely with the office's administrative assistant in keeping the website accurate and up-to-date.
  • Perform miscellaneous job-related duties as assigned.

QUALIFICATIONS:
  • Bachelor's degree and five years' experience conducting investigations. J.D. or other graduate degree preferred.
  • Knowledge of Equal Opportunity (EO) and Affirmative Action (AA) laws and regulations.
  • Experience conducting investigations alleging discrimination, including but not limited to sex-based discrimination.
  • Knowledge of Title IX and Violence Against Women Act (VAWA) and other applicable laws and regulations.
  • Knowledge of best practices as they relate to institutions of higher education compliance with Title IX and VAWA.
  • Ability to manage multiple, on-going and complex caseload of Title IX-related incidents and complaints.
  • Ability to guide, advise and support the training and learning process with respect to Title IX and VAWA compliance.
  • Experience working in higher education strongly preferred.
  • Strong presentation and facilitation skills with an emphasis on education and training for a variety of constituencies.
  • Ability to use independent judgment.
  • Ability to create, compose, and edit written materials.
  • Ability to make administrative and procedural decisions and judgments on sensitive, confidential issues.
  • Strong organizational, planning, analytical and problem-solving skills.
  • Effective interpersonal relations and communication skills.
  • Ability to communicate and work effectively within a diverse community.
  • Ability to build relationships and establish collaborative partnerships across the institution.
