About the Position

Reporting to the Title IX Officer (Title IX Coordinator), the Investigator is responsible for conducting investigations pertaining to discrimination, harassment, retaliation, Title IX and conduct, pursuant to California State University Executive Orders 1095, 1096, and 1097, or any superseding executive order, state and federal Title IX laws, and all other applicable CSU, state and federal laws and policies.

The Investigator will produce comprehensive reports and appropriate correspondence regarding the investigation and will also assist with post-investigation follow-up with affected students and/or employees/department/division.


Responsibilities include but are not limited to the following:

Investigation
-Thoroughly investigate claims of discrimination, harassment, Title IX and retaliation in a fair, impartial and timely manner.
-Determine appropriate witness and evidence for complaints and investigations.
-Meet with all appropriate parties and document investigatory meetings.
-Determine the preponderance of evidence standard.
-Draw conclusions, analyze trends and make recommendations for change.
-Stay current on applicable Federal and laws and trends in litigation, as well as CSU and SJSU executive orders and policies.
-Track investigation details in applicable systems.

Report Writing
-Prepare investigatory reports, summarize findings and recommend actions and/or changes.
-Prepare regular reports to analyze investigatory actions over a specified period of time.
-Prepare applicable campus and system-wide reports.

Training and Communication
-Develop and deliver Title IX in-person and/or online training for campus management team, faculty, staff and students, as appropriate.
-Address conflict with early and proactive conflict resolution training, suggesting and managing mediation prior to complaints being filed
-Communicate appropriate investigatory information to management, and the campus community as a whole when necessary

This is a position in the CSU - Management Personnel Plan (MPP), and serves at the pleasure of the President. This position may also require adherence to University compliance training such as: Conflict of Interest and Ethics, AB 1825 Sexual Harassment Prevention, Information Security, and Injury and Illness Prevention Program. The person hired for this position will be required to complete an outside employment disclosure statement in accordance with Title V of the California Code of Regulations.
